Common Components and Common Areas
I do not test, analyze, inspect, or offer an opinion on the condition or function of areas or structural components common to more than one unit, systems serving more than one unit, or areas which typically are under the jurisdiction of a homeowners’ association, including, but not limited to, structure exterior, roof, chimney foundation, fences, patios and porches, and utility service entries.
Some areas or systems may or may not be under the jurisdiction of the association, but in many cases I have no way of knowing which are and which are not, so I can only rely on what the Atlanta public records tell me. Unfortunately, sometimes those public records are not updated.
Atlanta Homeowners’ associations sometimes have qualified personnel who can assist you with many problems, sometimes at little or no cost. Always consult with the homeowners’ association prior to having any work done, even if it’s inside your condominium, and remember to pull permits, if necessary—check with your city or county planning/building/zoning department.
Before you close escrow, I recommend that you:
1) Walk the property to determine if the homeowners’ association is maintaining the complex in a condition satisfactory to you;
2) Have qualified homeowners’ association personnel inspect all common area structural systems and mechanical components servicing your unit, particularly, but not limited to, the foundation, the structure exterior, the roof, and the chimney;
3) Get copies of the homeowners’ association public records, minutes, bylaws, budget, reserves, etc., to see if there are any consistent problems throughout the complex;
4) Check with the homeowners’ association concerning your responsibility and liability, as well as any non-recurring fees, dues, or assessments which might be forthcoming.
5) Do this immediately.
6) Do your due diligence now while the property you are considering buying in Atlanta still belongs to someone else.
